1. What Wishpile is

Wishpile is a gift-planning service: gift lists, budgets, shared family wishlists, group gifts, and Secret Santa draws. Wishpile helps you plan and track gifts; it does not sell products, process gift purchases, or act as a retailer.

2. Eligibility and accounts

You must be at least 13 to have an account. Parents can manage wishlists for younger kids. Keep your login safe.

You must be at least 13 years old (or the minimum age required in your country to use an online service without parental consent, if higher) to create a Wishpile account. Children under that age may not create accounts. A parent or guardian may create and manage wishlists on a child's behalf from the parent's own account.

When you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account. If you believe your account has been compromised, contact us at support@wishpile.com.

3. Pricing

Wishpile is completely free. There are no paid plans, subscriptions, or in-app purchases, and we will never charge you to use it.

We will never charge you for using Wishpile. Wishpile earns a small referral fee from retailers when you buy through some product links, as described in section 8, at no extra cost to you.

4. Your content

Your lists, wishes, photos, and notes are yours. You give us permission to store and display them so the app can work.

You retain ownership of the content you add to Wishpile - gift lists, wishlist items, notes, photos, receipts, and similar materials (“Your Content”). You grant Wishpile a limited, worldwide, non-exclusive license to host, store, process, display, and transmit Your Content solely as needed to operate, maintain, and improve the Service - for example, showing a shared wishlist to the family members you've invited, or fetching a product's name, price, and image from a link you paste.

You are responsible for Your Content and must have the right to share anything you upload. We may remove content that violates these Terms.

5. Sharing, groups, and surprises

Sharing features work as described in the app. Be thoughtful about who you invite.

Wishpile includes sharing features such as family groups, households, shared wishlists, invite links, and Secret Santa draws. When you use these features, certain content becomes visible to the people you share with, according to the visibility rules described in the app. Anyone with an invite link you distribute may be able to use it, so share links only with people you trust.

Wishpile is designed to hide gifts, claims, and spending from the people they're intended for. We work hard to keep surprises safe, but we can't control what the humans in your group say at the dinner table.

6. Privacy

Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you agree to the Privacy Policy. We do not sell your personal data.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Upload content that is infringing, defamatory, harassing, or harmful, or that violates another person's rights;
• Attempt to access another user's account or data without authorization;
• Probe, scan, or test the vulnerability of the Service, or interfere with its operation;
• Scrape, harvest, or bulk-download data from the Service, or use automated means to access it except through interfaces we provide;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by law;
• Resell or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate this section.

8. Third-party links and products

Product links go to other companies' sites. Purchases are between you and the retailer, and prices we display can be out of date. Some links are affiliate links.

The Service lets you save links to third-party retailer websites and automatically retrieves product details such as names, prices, and images. We do not endorse any retailer or product, and we are not a party to any purchase you make. Product information displayed in Wishpile (including prices) may be incomplete, inaccurate, or out of date; always confirm details on the retailer's site before buying. Your use of third-party websites is governed by their own terms and privacy policies.

Some product links are affiliate links - if you buy through one, we may earn a small referral fee from the retailer at no extra cost to you. See our Privacy Policy for details.

9. Service availability and changes

Wishpile is live and actively developed, so features may change, and occasional downtime happens.

The Service is live and under active development. We may add, modify, or remove features at any time. We aim to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation, and we may suspend the Service for maintenance. You can delete your lists and account data at any time as described in the app.

10. Termination

You may stop using Wishpile and delete your account at any time. We may suspend or terminate your access to the Service if you materially violate these Terms, if required by law, or if we discontinue the Service. Upon termination, sections of these Terms that by their nature should survive (including Sections 4, 8, 11, 12, and 13) will survive.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we do not warrant that the Service will be accurate, complete, secure, or uninterrupted, or that surprises will never be spoiled. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Wishpile and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months before the claim arose, or (b) fifty US dollars ($50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Wishpile from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact us at support@wishpile.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you - for example, by email or an in-app notice - before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The “Effective date” at the top reflects the latest revision.
